Service Specific Terms & Conditions (“SSTC”) – Maxis Business AirFibre 79 & Maxis Business AirFibre 149

- The Plan: Maxis Business AirFibre 79 or Maxis Business AirFibre 149,
*Note:
Services Available: 4G 5G Maxis Business AirFibre 79 Yes Yes Maxis Business AirFibre 149 Yes Yes - You: The Business Customer or/and employees or contract staffs of a Business Customer signing up for the Plan who is either a new customer or an existing Maxis Business Customer [subject to the terms and conditions as set out herein].
- The Plan and the use of the Service(s) under the Plan is subject to the General Terms & Conditions (“GTC”), this Service Specific Terms & Conditions (“SSTC”), Summary Terms & Conditions (“STC”), Maxis Fair Usage Policy and any other applicable terms and conditions, all at https://business.maxis.com.my/terms-conditions/business/.
- Capitalised terms herein have the same meaning as defined in the GTC.
- Any conflict or inconsistency between this SSTC, the GTC and the STC, shall be construed in the following order of precedence: (a) SSTC; (b) GTC; and (c) STC.
- We reserve the rights without liability, to vary, add to, remove or otherwise amend this SSTC, the manner in which the Plan is conducted and/or discontinue, interrupt, bar, suspend, restrict and/or terminate the Plan (whether in whole or in part) at any time as we deem fit whether with or without prior notice to you and will not be liable to you and/or any third party for any loss (including loss of revenue), loss of services or connectivity or inconvenience as a result thereof. Where no prior notice is provided, Maxis will to the extent commercially reasonably practicable provide you with prior notice of such changes in any form as Maxis deems reasonable and appropriate. The prevailing terms and conditions of this SSTC and the Plan will be updated on our official website from time to time, whereby the updated terms and conditions will apply and supersede all previous versions. Your continued use of the Plan after any changes to the terms and conditions of this SSTC and the Plan is effective will constitute unconditional acceptance by you of such variations, additions or amendments and you will be bound by the same.
- The Plan: Maxis Business AirFibre 79 or Maxis Business AirFibre 149,

- You must be our Business Customer.
- You are ineligible for this Plan if you have any outstanding payments with us.
- The Plan is available with a Mobile Equipment or Subscriber Identity Module (“SIM”) only plan.
- Maxis reserves the right to alter the eligibility criteria at any time.

- The Charges and rates as set out in the Plan structure is as set out on our official website at https://business.maxis.com.my/en/plans/business-wifi/ and may be updated by us at our sole and absolute discretion as published on our official website from time to time, where the updated structure will apply and supersede all previous versions. Charges and rates published are exclusive of all applicable taxes.
- Your bills are available in electronic format if you sign up for E-Billing service via Maxis Online Account or Maxis Business Hub and a copy will be sent to your nominated email address.
- Maxis reserves the right to change the Charges and rates for the Plan from time to time.

- A deposit of RM500 is chargeable if you are a non-registered Malaysian entity or you are controlled by a director who is a non-Malaysian.
- Advance payment based on the rate plan under this Plan may be chargeable to you.
- Non-payment for any one of the packages may result in suspension or barring of all the Service(s) until the outstanding amount is paid.

- You acknowledge and accept:
- if your data usage for the Service(s) exceeds Quota in a month, Maxis may at its absolute discretion to throttle the speed.
- the wireless internet data package allocated within the Services(s) under the Plan is exclusively for domestic usage only. International / overseas roaming is not applicable under the Plan;
- The mobile internet data allocation for the Plans is specified as per Plan and you acknowledge and agree that:
- For Maxis AirFibre 79 : For the mobile internet data allocated with this Plan, you acknowledge and accept if your data usage exceeds 1500GB in a month, Maxis may at its absolute discretion limit the quality of video streaming to standard definition during peak hours and will be throttled to 512Kbps
- For Maxis AirFibre 149 : For the mobile internet data allocated with this Plan, you acknowledge and accept if your data usage exceeds 1500GB in a month, Maxis may at its absolute discretion limit the quality of video streaming to standard definition during peak hours and will be throttled to 512Kbps
- If you subscribe for Maxis Business AirFibre 149 Plan you are further subject to the following terms and conditions:
- Voice Calls
You acknowledge and accept, that the following shall apply with regards to the minutes allocated to you for Voice calls under the Maxis Business AirFibre 149 Plan:- Domestic mobile/fixed ON-net (Maxis to Maxis calls) & OFF-net (calls from Maxis to other Service Provider) usage (excluding, video calls, calls to special numbers, eg.1-300/1-800/600, 121, TM100, 1MOCC, 02-pre_x numbers for IDD calls to Singapore & 080-pre_x numbers for border calls to Brunei) & Unity Hotline;
- are for standard person to person calls;
- it is NOT meant for video calls, multiple simultaneous calling, conference calling, re-supply, call centre usage, telemarketing, bulk messaging, application-to-person communication, continuously call forwarding, auto-dialling, machine-to-machine communication (including by using your SIM card in any other devices), Cellular Trunking Units (CTUs), or any other activity we consider to be non-standard usage.
- Voice Calls
- If you subscribe for Maxis Business AirFibre 149 Plan, you are further subject to the following terms and conditions:
You acknowledge and accept, that the following shall apply with regards to Maxis Business AirFibre 149 Plan:- Minimum Period of Service
You will enter a contract for a minimum period (“Minimum Period of Service”) of twenty-four (24) months from the date of activation of the Service(s) and will continue until terminated in accordance with this SSTC. - 5G Router
- You will be provided with one (1) unit of router with capable, supported and enabled 5G service(s) (“5G Router”) with an embedded SIM Card; and
- The 5G Router shall only be used by you together with the SIM Card and not individually at any one time.
- Early Termination Charge
If you terminate or change your Maxis Business AirFibre 149 Plan within the Minimum Period of Service of twenty-four (24) months, you will be charged the early termination charge calculated based on: Monthly commitment x remaining months of the Minimum Period of Service.
- Minimum Period of Service
- You acknowledge and accept:

- The Mobile Equipment including the 5G Router, provided under the Service(s) by us are:
- on a “while stocks last” basis;
- subject to the suppliers’ terms and conditions; and
- comes with a one (1) year warranty.
- We reserve the rights to change the Mobile Equipment model from time to time.
- The one (1) year warranty does not cover:
- The SIM and Mobile Equipment holder;
- Damage, loss or defects caused by any act, omission, misuse, negligence including usage of the Mobile Equipment contrary to instructions provided by Maxis or the manufacturer (as set out in the Mobile Equipment user guide); and/or
- Other acts beyond our reasonable control.
- Please visit your nearest Maxis Centre should you have any issues with the Mobile Equipment.
- If you discontinue the Service(s) before the expiry of the Minimum Period of Service, you need to return the Mobile Equipment to us and will be charged with the early termination charges as stated in Clause 17(C) above.
- You are responsible, at all times, for the safety of the Mobile Equipment.
- The Mobile Equipment including the 5G Router, provided under the Service(s) by us are:

- Subject to the GTC, you may at any time terminate the Plan by giving us at least thirty (30) days’ prior written notice by writing in to customercare@maxis.com.my or bizcare@maxis.com.my.
- Additional Clauses in relation to 5G service(s)
- Availability and Usage
- You must:-
- have a 5G capable, supported and enabled Mobile Equipment to access or utilize the 5G network. A 5G software update from the device manufacturer may be required which will be your sole responsibility and shall not be the responsibility of Maxis;
- located within the 5G network coverage area. A map of 5G network coverage area can be found at https://www.maxis.com.my/en/about-maxis/5g-network/#5g-map; and
- have a 4G LTE enabled SIM. You may check your SIM status by dialling this code *100*8*5# from your phone.
- The 5G service(s) is only available within the 5G network coverage area via use of a capable, supported and enabled 5G router. When you are located or relocated outside the 5G network coverage area, you will automatically switch to any of our other available networks.
- You must:-
- Restrictions and Exclusions of Liability When Using 5G service(s)
- Maxis does not represent, warrant, undertake and/or guarantee that the 5G service(s) will be:
- provided without errors;
- uninterrupted; and/or
- that your experience of the existing services which you are subscribing from Maxis on our other available networks will not be impacted in an adverse manner,
- Without derogating from the disclaimers and limitation of liability under the GTC which are applicable to you, Maxis makes no representation or give any condition, indemnity, warranty, guarantee, whether express or implied, about whether the 5G service(s) will operate and be compatible with any Content, Equipment, hardware or software or that it will be compatible with the national 5G wholesale network. You acknowledge and agree that Maxis relies on one or more third party service providers in relation to the Plan (including its availability and continuity) and as such, to the fullest extent permitted by law, Maxis excludes any liability and shall not be liable to you and/or any third parties whether in contract, tort or otherwise for any loss, damage or liability incurred or sustained by you and/or any third party (including loss of revenue or loss of services or connectivity) caused by or in relation to any delay, failure, breakdown, inability to use or access, interruption or disruption by any of our third party service providers including Maxis’ third party provider of the national 5G wholesale network or in respect of interruption or adverse impact to existing services subscribed from Maxis arising from your subscription of the Plan/ 5G services(s).
- Notwithstanding anything to the contrary in this SSTC, you acknowledge and agree that:
- you have not relied on any representation, warranty, statement or similar made by Maxis’ third party service provider of the national 5G wholesale network in connection with your decision to use or the manner in which you will make use of the Plan and/or 5G service(s) including where such Plan and/or Service(s) is provided to you as part of products or services (or bundled products or services) by Maxis;
- you are solely responsible for your decision to use, and the manner in which you will make use of, the Plan and/or 5G service(s) and does so at your own risk (including where the Plan and/or Service(s) is used in connection with the preservation of life or property);
- you are solely responsible for making your own decisions on appropriate alternative redundancy, connectivity and data solutions in the event the Plan and/or 5G service(s) is unavailable, disrupted or operate with error;
- the Plan and/or 5G service(s) will not necessarily operate without error and will not always be available;
- Maxis’ third party service provider of the national 5G wholesale network does not owe you any duty of care or similar duty and you release Maxis’ third party service provider of the national 5G wholesale network from any liability arising from your use of the Plan and/or Services; and
- you must not do anything that may interfere with Maxis’ third party service provider of the national 5G wholesale network and/or connect or knowingly permit any third party to connect any equipment to the 5G network.
- Maxis does not represent, warrant, undertake and/or guarantee that the 5G service(s) will be:
- In connection to any 5G-related survey, comments, suggestions and/or feedback submitted by you to Maxis, you agree that Maxis may use all comments, suggestions and feedback collected in any manner without restriction or obligation for any purpose, including but not limited to incorporation or implementation of such comments, suggestions and feedback into Maxis’ product or service, to develop, improve and/or evaluate the Service(s). Except for personal data, no comments, suggestions and/or feedback will be deemed as your confidential information.
- Availability and Usage

- We reserve the rights at any time at our sole discretion whether with or without prior notice to you and without being liable to you and/or any third party, to immediately interrupt, bar, suspend, restrict the Service(s) for such time as we see fit or withdraw, terminate, discontinue or disconnect the Service(s) including if:
- any technical failure occurs in the Service(s) or our Network (which includes any network operated by any third party which are connected to Maxis’ network);
- the Service(s), our Network or systems are being upgraded, modified or maintained;
- your usage shows excessive usage or placing unusual burdens on our Network;
- in our determination that the Service(s) is or may be used by you for unlawful activities or for suspected fraudulent activities; your usage is not in accordance with the Maxis Fair Usage Policy (at www.maxis.com.my/FUP) or contrary to any of the terms and conditions of this SSTC and/or the GTC;
- is for reselling purposes;
- where matters beyond our reasonable control prevents us from performing and/ or continuing our obligations this SSTC, the GTC and/or the Maxis Fair Usage Policy; or
- we are required to do so by law, statute, enactment, regulations, code or by any relevant authorities, including the Maxis’ third party service provider of the national 5G wholesale network,
- We reserve the rights at any time at our sole discretion whether with or without prior notice to you and without being liable to you and/or any third party, to immediately interrupt, bar, suspend, restrict the Service(s) for such time as we see fit or withdraw, terminate, discontinue or disconnect the Service(s) including if:
