Service Specific Terms & Conditions (“SSTC”) – Jualan Merdeka (West Malaysia)

Introduction

1. Offer Period:
   The Campaign shall commence on 2 August 2022 on a “while stocks last basis”.
2. Eligibility:
   The Campaign is only available during the Offer Period for the following:-
   1. new subscription or registration;
   2. renewal of contract;
   3. existing line with no contract; or
   4. successful application to port-in;
   5. Prepaid lines converted to Postpaid lines.

   The Campaign is not available to existing mobile line(s) with Mobile Device contracts. Business Customer with existing contracts must complete the contract period in full in order to be eligible.

3. Offer Package(s): 
   1. The Offer Package(s) available for subscription under this Campaign are as below:
      1. Maxis Business Postpaid 48/68/98/108/128/158/188 (“Offer Package 1”)

2. Maxis Business Postpaid 98/128 (“Offer Package 2”)

2. You will be entitled to receive one (1) Mobile Device for each of the subscriptions of the Offer Package(s) during the Offer Period, subject to the following terms and conditions:
   Offer Package 1
   For Offer Package 1, you will be entitled to receive one (1) Mobile Device at the offered price stipulated if you sign up for a new line or renew your existing line under any of the Bundle Offers 1A to 1G.
   Offer Package 2
   For Offer Package 2, you will be entitled to receive one (1) Mobile Device at the offered price stipulated if you sign up for a new line or renew your existing line under any of the Bundle Offers 2A to 2B.
   
3. You are entitled to one (1) Mobile Device for each Bundle Offer subscription under the Offer Package(s). You can subscribe for multiple Offer Package(s) but the maximum number of your subscription for the Offer Package(s) during the Campaign shall be subject to Maxis’ sole and absolute discretion.
4. Mobile Device refers to the Mobile Device that you are eligible to purchase under the Campaign as stipulated in the Maxis Registration Form. Only selected Mobile Device are available under the Campaign based on the availability of stocks. Maxis shall have the sole and absolute discretion to decide on the offering of the Mobile Device for each of the Offer Package(s).
5. The accompanying line(s) under the Offer Package(s) for Maxis Business Postpaid 48 must be new line registration, either via new line registration or port-in.
6. The subscription in Offer Package(s) 1 is subject to a minimum twenty-four (24) months contract period and the subscription in Offer Package(s) 2 is subject to a minimum twelve (12) months contract period (“Minimum Period of Subscription” (as the case may be)). This applies to any renewal of existing line(s) under the Offer Package(s).
7. Any early termination of the line(s) subscribed in the Offer Package(s) by you prior to the expiry of the Minimum Period of Subscription will incur early termination charges, which shall be calculated based on the following formula:
   Monthly commitment fee  X  Remaining months of the Minimum Period of Subscription

General

4. By subscribing to the Offer Package(s), you agree to be bound by these terms and conditions which shall form an integral part and to be read together with the General Terms & Conditions (“GTC”), Service Specific Terms & Conditions (“SSTC”) and applicable addendums, Summary Terms & Conditions (“STC”), Maxis Fair Usage Policy, Maxis Group Privacy Statement and any other applicable terms and conditions, all available at https://business.maxis.com.my/terms-conditions/business.
5. We are entitled at our discretion without liability, from time to time, to vary, add to, remove or otherwise amend these terms and conditions or any part thereof and/or withdraw or cancel the Offer Package(s) and the Campaign without any prior notice. Where reasonably practicable, we will give you reasonable advance notice of such changes and all previous versions of our user guides or leaflets will be superseded.
6. The Device(s) and the models offered under the Offer Package(s) are subject to availability. The Device(s) are subject to the device manufacturer’s terms and conditions (as applicable). Maxis reserves the sole and absolute right to change and/or replace the models and types of the Device(s) without any prior notice given to you at any time.
7. The Offer Package(s) are not valid in conjunction with other on-going offers, discounts, net-price products, rebates or privileges, unless otherwise allowed by Maxis.
8. Our decisions in any matter in relation to the Offer Package(s) shall be final and conclusive and any request for appeal or review will not be entertained.
9. All charges and prices stated are exclusive of all applicable taxes. Any applicable taxes shall be charged and added to the bills issued to you.
10. We will not be liable for any claims by you or any third party for loss or damages of any nature, including but not limited to loss of profits, loss of reputation, loss of savings, punitive, indirect, incidental, special or consequential damages or for any other damages and any related claims of any nature, including direct, indirect, third party, consequential or other damages resulting from or in connection with your subscription of the Offer Package(s).
11. Any conflict or inconsistency between these terms and conditions, the SSTC, the GTC and the STC, shall be construed in the following order of precedence: (a) these terms and conditions; (b) SSTC; (c) GTC; and (d) STC.
12. If any of the provision in these terms and conditions is held to be invalid, illegal and unenforceable under any applicable law or court of law or by any reasons whatsoever, the legality and enforceability of the remaining provisions shall not be affected or impaired in any way and such invalid, illegal or unenforceable provision shall be deemed deleted.
