Terms & Conditions

Service Specific Terms & Conditions (“SSTC”) – Maxis Business Postpaid and FibreContent Version

Version [15 August 2023]

    1. The Plan(s): Maxis Business Postpaid & Maxis Business Fibre comprising:
      • Maxis Business Postpaid Share 48, Maxis Business Postpaid 79, Maxis Business Postpaid 109, Maxis Business Postpaid 139, Maxis Business Postpaid 169 or Maxis Business Postpaid 199 (“Maxis Business Postpaid”); and
      • Maxis Business Fibre plan 30Mbps, 100Mbps, 300Mbps, 500Mbps or 800Mbps (“Maxis Business Fibre”).
    2. You: The Business Customer signing up for the Plan(s)
    3. If you change your existing rate plan to the Plan(s), you may not be able to carry forward any promotions/ benefits that you are currently enjoying under your existing rate plan to the Plan(s) subscribed to.
    4. The use of the Plan(s) and Service(s) is subject to the General Terms & Conditions (“GTC”) at https://www.business.maxis.com.my/en/terms-conditions/business/general/tnc/, Service Specific Terms & Conditions (“SSTC”), Summary Terms and Conditions (“STC”), Maxis Fair Usage Policy and any other applicable terms and conditions, all at https://www.business.maxis.com.my/terms-conditions/business/.
    5. Capitalised terms herein have the same meaning as defined in the GTC.
    6. Any conflict or inconsistency between this SSTC, the GTC and Summary Terms and STC, shall be construed in the following order of precedence: (a) SSTC; (b) GTC; and (c) STC. 
    7. Further, please note that: 
      1. the Maxis Business Postpaid under the Plan(s) is subject to SSTC – Maxis Business Postpaid Plan(s) at
        https://www.business.maxis.com.my/en/plans/postpaid-plan/ and
      2. the Maxis Business Fibre under the Plan(s) are subject to SSTC – Maxis Business Fibre Plan(s)
        (https://www.business.maxis.com.my/en/data-internet/fibre/). 
    For clarity, any conflict or inconsistency between this SSTC, SSTC – Maxis Business Postpaid and SSTC – Maxis Business Fibre, this SSTC shall take precedence.
     
    1. We reserve the rights without liability, to vary, add to, remove or otherwise amend this SSTC, the manner in which the Plan(s) is conducted and/or discontinue, interrupt, bar, suspend, restrict and/or terminate the Plan(s) (whether in whole or in part) at any time as we deem fit whether with or without prior notice to you and will not be liable to you and/or any third party for any loss (including loss of revenue), loss of services or connectivity or inconvenience as a result thereof. Where no prior notice is provided, Maxis will to the extent commercially reasonably practicable provide you with prior notice of such changes in any form as Maxis deems reasonable and appropriate. The prevailing terms and conditions of this SSTC and the Plan(s) will be updated on our official website from time to time, whereby the updated terms and conditions will apply and supersede all previous versions. Your continued use of the Plan(s) after any changes to the terms and conditions of this SSTC and the Plan(s) is effective will constitute unconditional acceptance by you of such variations, additions or amendments and you will be bound by the same.
       
    1. The Plan(s) are only available in certain coverage areas. Call 1919 (from your mobile), 1800 82 1919 or log onto https://www.business.maxis.com.my/support/coverage-checker/ to check if you are within the coverage area.

    1. You must be our Business Customer and must be eligible according to the SSTC – Maxis Business Postpaid Plan(s) and the SSTC – Maxis Business Fibre Plan(s).
    2. You are ineligible for this Plan(s) if you have any outstanding payments with us.
    3. The provision of Service(s) is contingent on your Premises being-fibre ready and having a termination point within the Premises.
    4. We reserve the rights to change the eligibility criteria for the Plan(s) at any time. 
       
    1. The Plan(s) shall continue for twenty-four (24) months (“Minimum Period of Service”) from the date of activation of the Plan(s) if subscribed with any Mobile Device contract, Enterprise Loyalty Program, Zerolution, rebate model and/or roaming offers.

    1. Non-payment for any one of the Service(s) under the Plan(s) may result in suspension or barring of all the Service(s) until the outstanding amount is paid.

    1. We reserve the rights at any time at our sole discretion whether with or without notice to you and without being liable to you or any third party, to immediately interrupt, bar, suspend, restrict the Service(s) (including 5G service(s)) for such time as we see fit or terminate, discontinue or disconnect the Service(s) including if:
      • any technical failure occurs in services pursuant to the 5G service(s), Plan(s) or our Network (which includes any network operated by any third party which are connected to Maxis’ network);
      • the services pursuant to the 5G service(s), Plan(s), our Network or systems are being upgraded, modified or maintained;
      • your usage shows excessive usage or placing unusual burdens on our Network;
      • in our determination that the Plan(s) is or may be used by you for unlawful activities or for suspected fraudulent activities;
      • your usage is not in accordance with the Maxis Fair Usage Policy at www.maxis.com.my/FUP or contrary to any of the terms and conditions of this SSTC and/or the GTC;
      • is for reselling purposes;
      • where matters beyond our reasonable control prevents us from performing and/ or continuing our obligations in this SSTC, the GTC and/or the Maxis Fair Usage Policy;
      • you have relocated or have been relocated to an area outside the 5G network coverage area; or
      • we are required to do so by law, statute, enactment, regulations, code or by any relevant authorities, including the Maxis’ third party service provider of the national 5G wholesale network

    and where no prior notice is provided, Maxis may to the extent commercially reasonably practicable give you notice of such changes in any form as Maxis deem reasonable or appropriate.
     

    1. For mobile data allocated for the Plan(s), you acknowledge and accept:
      • The mobile data usage limit allocated under the Plan(s) is exclusively for domestic usage only;
      • You can opt for upgrades or downgrades at any Maxis Service Centre or Maxis Exclusive Partners (MEP) or our Contact Centre’s (1919); and
      • If you upgrade or downgrade to another Maxis Business Postpaid plan, your monthly commitment fee will be pro-rated against your billing cycle date. You will be charged the full commitment fee from the second month onwards but with full mobile data allocation from the first month.
         
    1. The Charges and rates outlined in the Plan(s) structure do not account for usages while on an overseas roaming network. Whilst roaming overseas, the prevailing data roaming charges at https://www.business.maxis.com.my/mobile/international-roaming/ applies.

    1. You will only be able to enjoy the benefits of the Plan(s) after the activation of your subscribed Maxis Business Fibre plan. For clarity:
      • If for any reason, your subscribed Maxis Business Postpaid plan and/or Maxis Business Fibre plan under the Plan(s) fails to be activated or installed, you are deemed not to have been registered for the Plan(s); and
      • If either of your subscribed Maxis Business Postpaid plan or Maxis Business Fibre plan is successfully activated or installed, you are deemed to have been registered for the respective Maxis Business Postpaid plan (under the SSTC – Maxis Business Postpaid Plan(s)) or Maxis Business Fibre plan (under the SSTC – Maxis Business Fibre Plan(s)).
    2. Upon registration for the Plan(s), your Maxis Business Postpaid plan and Maxis Business Fibre plan must be kept active and not suspended during the Minimum Period of Service if you want to enjoy the benefits of the Plan(s). 
    3. Maxis reserves the right to remove all benefits of such Plan(s), if you suspend your Maxis Business Fibre plan and/ or Maxis Business Postpaid plan.
       
    1. Subject to our GTC and this SSTC, a principal line holder may at any time terminate the Plan(s) as follows:
      • by writing in to customercare@maxis.com.my or bizcare@maxis.com.my; or
      • by calling our business customer care line at 1-800-82-1919 or dial 1919 from your mobile; or
      • by walking into our Maxis Centre’s listed on www.maxis.com.my.
    2. Your Plan(s) may be terminated if you make any changes to your Plan(s) other than an upgrade.
    3. Upon termination of your Plan(s), all benefits under the Plan(s) will automatically ceased to be applicable.
    4. For any planned interruption of Service(s), adequate notice will be provided via a valid mobile number and/or any other mode of communication as we may deem appropriate.
       
    1. The terms and conditions for the 5G service(s) for your Maxis Business Postpaid plan is as set out at

    1. Upon your subscription to the Plan(s), you are eligible to enter into selected device contracts with us, which are subject to the respective device contract terms and conditions including device warranty (if any). Subscription to the Plan(s) does not affect your existing device contracts with us (if any).
    2. Upon your subscription to the Plan(s), you are no longer entitled to subscribe for the mobile internet data pass ("Mobile Internet Pass”). For clarity, the Mobile Internet Pass is not transferrable to this Plan(s).
    3. For Porting request to another service provider after your subscription to the Plan(s), subject to the terms and conditions under Maxis Business Fibre plan, you are required to contact Maxis to detach Maxis Business Fibre plan from this Plan(s) before any Porting to another service provider.
       

Appendix – Service Specific Terms & Conditions (“SSTC”)

Maxis Business Postpaid & Fibre:

You are entitled to sign up for the following:

  • One (1) eSMS service free of charge for twenty-four (24) months for each Plan(s); and/ or
  • One (1) Maxis Business VoiceGo service free of charge for twenty-four (24) months for each Plan(s).
