• General

  1. The Campaign: Download Maxis App (Business) Campaign
  2. You: Eligible Participant who downloads the Maxis App for the first time, logs in and purchases a Roaming and/or Internet pass during the Campaign Period.
     
  3. Campaign Period: from 1st June 2023 until 30th November 2023 (both dates inclusive).
  4. The Campaign and use of the Service(s) is subject to the General Terms & Conditions (“GTC”) https://www.business.maxis.com.my/en/terms-conditions/general/tnc/, this Service Specific Terms & Conditions (“SSTC”), Summary Terms and Conditions (“STC”) at https://www.maxis.com.my/en/terms-conditions/general/summary/, Maxis Fair Usage Policy at https://www.business.maxis.com.my/en/terms-conditions/general/fair-usage-policy/, Maxis Group Privacy Statement at https://www.maxis.com.my/en/privacy-notice/ and any other applicable terms and conditions, all available and https://www.business.maxis.com.my/en/terms-conditions/.
     
  5. Capitalised terms herein have the same meaning as defined in the GTC.
     
  6. Any conflict or inconsistency between this SSTC, the GTC and STC, shall be construed in the following order of precedence: (a) SSTC; (b) GTC; and (c) STC.
     
  7. By participating in this Campaign, you agree to be bound by these terms and conditions and consent to allow your personal data being collected, processed and used by Maxis in accordance with Maxis Group Privacy Statement at https://www.maxis.com.my/en/privacy-notice/. In addition, the terms and conditions applicable for the use of the content and/or service, including terms and conditions for the use of the relevant content and/or service shall apply to you. Failure to comply with any applicable terms, conditions, rules, regulations, instructions or methods shall result in disqualified from the Campaign.

• Eligibility

  8. Open to all active Maxis Business Postpaid customers (mobile on any plans), who are at least 18 years of age (“Eligible Participants” or each, an “Eligible Participant”).
  9. Eligible Participants must use the same mobile number registered under their Maxis Business account (“Maxis Business Postpaid Line”) to participate in this Campaign and maintain an active account during the Campaign Period. The account must not be suspended or terminated for any reason whatsoever during the Campaign Period until the selection of winners.
  10. Eligible Participants are required to participate in the Campaign by satisfying the requirements set out in Clause 12 below to stand a chance in winning the Prizes provided in Clause 14.
  11. The following group of persons shall not be eligible to participate in this Campaign: -
      • Any customers who have already downloaded and/or logged onto the Maxis App before 1^st June 2023 using the mobile line under their Maxis Business account;
      • permanent or contract or temporary employees of Maxis (including its associated or related companies) and their immediate family members (children, parents, brothers and sisters, including spouses); or
      • representatives, dealers, employees and/or agents of Maxis and their immediate family members (children, parents, brothers and sisters, including spouses); or
      • if you are a Maxis Mobile consumer, Hotlink Prepaid, Hotlink Postpaid and/or Maxis Fibre consumers; or
      • any person who has committed or suspected of committing any misconduct, fraudulent or wrongful acts in relation to his/her Maxis/ Hotlink account.

• How to Participate

  12. During the Campaign Period, the Eligible Participant(s) are required to download the Maxis App and purchase a Roaming Pass (with a minimum value of RM49), an Internet Pass (with a minimum value of RM6) and/or combination of both Roaming and Internet Pass (with a combined minimum value RM55. For the avoidance of doubt, all amounts stated herein are exclusive of Service Tax).
  13. Each interaction the Eligible Participant(s) make is counted as one (1) qualifying entry to stand a chance to win prizes under this Campaign.
  14. Any entry received by Maxis’ system after 30th November 2023 will automatically be disqualified and considered null and void.

• Prizes

  15. The Campaign Prizes details are:

  16. Subject to the terms and conditions herein, the winners of the Prizes ("Winners") will be selected, based on the following mechanics: -
      
      • Prizes
        1. All entries from the Eligible Participants will stand a chance to win one (1) Prize. Each Eligible Participant is only entitled to one (1) Prize per Maxis Business Postpaid line.
           
        2. Maxis will contact the shortlisted winner of the Prize according to the timetable set out in Clause 16 below.
        3. Maxis shall notify the shortlisted winners via SMS (‘notification SMS’) on the Maxis Business Postpaid line used to participate in the campaign.
           
        4. Within the time stated in the notification SMS, the shortlisted winner(s) must respond to the SMS to confirm their preferred contact details (SMS/Email) for the TnG Reload Pin to be sent to. If the shortlisted winner(s) does not provide their response as per Clause 15(c), Maxis reserves the right to select a new shortlisted winner.
           
  17. Winners will be randomly selected from all qualifying entries received by Maxis through a computer process that produces a verifiably random result from those valid entries received each month during the Campaign Period per table below: -

• General Terms of the Campaign

  18. Each Eligible Participant is entitled to receive only ONE (1) Prize throughout the Campaign Period.
  19. By participating in this Campaign, you agree to be bound by the terms and conditions contained herein and Maxis Group Privacy Notice at https://www.maxis.com.my/en/privacy-notice/. Failure to comply with any applicable terms, conditions, rules, regulations, instructions, or methods shall result in you being disqualified from the Campaign.
  20. Maxis reserves the right to forfeit the Prize if our attempt to deliver the Prize fails for any reason whatsoever. Maxis shall not be responsible or liable in anyway whatsoever in the event the Prize is not redeemed by the Winner.
  21. Maxis’ decision on the selection of Winner and/or the Prizes shall be final and conclusive and Maxis shall entertain no correspondence, complaint, or appeal at any time during or after the Campaign Period. The Winner is not allowed to choose the variation or type of Prizes.
  22. The Prizes set out above shall be always used/taken entirely at the risk of the Winner and Maxis excludes all warranties and liabilities in connection with the prize to the fullest extent permitted by law. The Prizes are non-transferable, non-assignable and non-exchangeable for cash or any other item.
  23. The Winners shall be responsible for any additional costs, duties, taxes and/or other incidental expenses, which may be incurred as a result of and/or related to the Winner’s acceptance or use of the Prizes.
  24. By accepting the Prizes, the Winners expressly grant permission to Maxis and its agencies or partners to use the Winner’s name, photograph and/or likeness for purposes of advertising, editorial, promotional, marketing, trade and/or other purposes without further compensation and notice.
  25. Acceptance of the Prizes by the Winners constitute a release and discharge of Maxis and/or its related companies, by or from any and all liability, claims, demands, actions and/or damages which the Winners may have, whether known or unknown at the present time, of any nature whatsoever, arising out of or relating to-
      1. the Campaign;
      2. personal injury and/or property damage, theft or loss suffered by the winner as a result of the use, employment and/or acceptance of the Prizes or participation/presence in the Campaign; or
      3. any tax liabilities in relation to the Campaign, Prizes and/or use or enjoyment of the same.
  26. Maxis reserves the right: -
      1. to change, amend, revise, supplement, delete, vary or add to these terms and conditions without prior notice at any time and you shall be bound to such changes, amendments, revisions, supplements, deletions, variations or additions;
      2. at any time, change any aspect of the Campaign (including the Prizes and discontinuing the Campaign) without prior notice; and
      3. at Maxis sole discretion to cancel, suspend, modify or delay the Campaign or tabulation of votes in the event of unforeseen circumstances beyond its reasonable control.
  27. We disclaim and exclude all warranties relating to or in connection with the Campaign and the Prizes including warranties of merchantability, fitness for a particular purposes, security and accuracy.
  28. In no event shall Maxis, its related and affiliated corporations, sponsors, agencies and representatives be liable to you or to anyone else for any loss or injury or any direct, indirect, special, exemplary, consequential damages, or any damages whatsoever, whether in contract, negligence or in tort, arising out of or in connection the Campaign, the Prizes and your participation in the Campaign including (without limitation) any cancellation or postponement of the rewards by its organizers.
  29. Maxis shall not be liable to the Eligible Participants or any other party for any loss or damage of whatsoever nature suffered by an Eligible Participant or such other party as a result of participation or non-participation in the Campaign or as a result of any act or omission on Maxis’ part.
  30. Maxis shall not responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, unauthorized access to, or alteration of, user or member communications, or any problems or technical malfunction of our telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of e-mail or players on account of technical problems or traffic congestion on the Internet.
  31. Maxis reserves the right, in its sole discretion, to disqualify any participant that is found or suspected of tampering with the Campaign submission process, the operation of this Campaign or to be in violation of these terms and conditions. Maxis reserves the right to disqualify any Eligible Participant(s) and/or to forfeit any Prize and/or reward from any Eligible Participant(s) it believes has undertaken fraudulent practice and/or activities or other activities harmful to this Campaign or the Campaign submission process. Fraudulent activities are deemed to include but not be limited to the following-
      1. any act of deceit and/or deception and/or cheating;
      2. ubmission of answers and/or entries and/or responses by any person other than the natural person who is the named Maxis subscriber participating in the Campaign; and/or
      3. submission of answers and/or entries and/or responses wholly or partially by way of and/or generated by way of any electrical device, computer, pre-programmed modem or by any other method or device which contravenes the submission of answers and/or entries and/or responses as stipulated in Clause 34(b) herein above.
  32. The terms and conditions stated herein shall be governed by the Laws of Malaysia and subject to the exclusive jurisdiction of the courts of Malaysia.
