Service Specific Terms & Conditions – Enterprise Loyalty Program

- This Enterprise Loyalty Program is designed by Maxis for its Business Customer(s), which allows its Business Customer(s) to earn points when they subscribe to Service(s) with Maxis (“Enterprise Loyalty Program”).
- This Enterprise Loyalty Program is subject to the General Terms & Conditions (“GTC”), this Service Specific Terms & Conditions – Enterprise Loyalty Program (“SSTC”), Maxis Fair Usage Policy, Maxis Group Privacy Notice and any other applicable terms and conditions, all at https://www.business.maxis.com.my/en/terms-conditions/.
- Capitalised terms not defined herein have the same meaning as defined in the GTC.
- Further, this SSTC is subject to the other Service Specific Terms & Conditions applicable to your subscription of Service(s) at https://www.business.maxis.com.my/en/terms-conditions/ (“SSTC for Service(s)”)
- For clarity, any conflict or inconsistency between:
- this SSTC, the GTC and Summary Terms and Conditions (“STC”), shall be construed in the following order of precedence: (a) SSTC; (b) GTC; and (c) STC; or
- this SSTC and the SSTC for Service(s), this SSTC shall take precedence, in respect of the Enterprise Loyalty Program unless as stated otherwise in the SSTC for Service(s).
- We reserve the rights without liability, to vary, add to, remove or otherwise amend this SSTC, the manner in which the Enterprise Loyalty Program is conducted and/or discontinue, interrupt, bar, suspend, restrict and/or terminate the Enterprise Loyalty Program (whether in whole or in part) at any time as we deem fit whether with or without prior notice to you and will not be liable to you and/or any third party for any loss (including loss of revenue), loss of services or connectivity or inconvenience as a result thereof. Where no prior notice is provided, Maxis will to the extent commercially reasonably practicable provide you with prior notice of such changes in any form as Maxis deems reasonable and appropriate. The prevailing terms and conditions of this SSTC and the Enterprise Loyalty Program will be updated on our official website from time to time, whereby the updated terms and conditions will apply and supersede all previous versions. Your continued use of the Service(s) relevant to the Enterprise Loyalty Program after any changes to the terms and conditions of this SSTC and the Enterprise Loyalty Program is effective will constitute unconditional acceptance by you of such variations, additions or amendments and you will be bound by the same.

- "Business Customer” means Maxis Business Customer(s) registered with Suruhanjaya Syarikat Malaysia (SSM).
- "Maxis Business Hub” means a self-serve portal that allows Business Customers to login and access their Account(s).
- "Catalogue” means the catalogue or list of Redemption Items that are available to be redeemed by you under this Enterprise Loyalty Program as provided in the Maxis Business Hub
- "Reward Points” means the points accumulated through the Enterprise Loyalty Program.
- "Account(s)” means your account that you registered with Maxis Business Hub being our Business Customer.
- "Reward Items” refers to the Service(s) that are available for redemption as listed in Maxis Business Hub.
- "Partners” includes firms, businesses or companies with whom Maxis, or a third party on behalf of Maxis, partners with to provide Reward Items featured in this Enterprise Loyalty Program.

- You may participate in the Enterprise Loyalty Program provided you have subscribed to Service(s) and such subscription(s) must always be active and valid.

- You can earn Reward Points through:
- Service(s) subscription(s);
- award from Maxis to you through your employee(s) individual service subscriptions.
- Reward Points earned are valid and can be redeemed within two (2) years from the date which the Customer(s) earned them. After this the Reward Points will expire.
- Reward Points may be used for redemption of Reward Items listed in the Reward Catalogue.
- Reward Points in the Account are not transferable, non-assignable and non-exchangeable for cash.
- Reward Points across different Accounts cannot be combined or transferred.
- Reward Points are not valid with any other offers, incentives and/or device offers unless it is stated in the Reward Catalogue.
- You will be able to view your Reward Points information and transactions such as points earned, redemption, adjustment, refund, balance and expiry in your Account.
- You are responsible for checking your own Rewards Points in the Account to make sure Reward Points arising from the manner the Reward Points can be earned as specified in Clause 9 above have been credited to your Account.
- You are responsible to check your Reward Points balance and the Reward Points expiry date(s).
- Maxis is not responsible for any delay in the posting of transactions which may result in a delay in the accrual of Reward Points.
- The Reward Points will not be accrued on any un-posted or cancelled subscription.
- Maxis reserve the right to adjust the Reward Points balance if the Reward Points have been added or removed by error, or due to disputed, cancelled or refunded transactions. This includes Reward Points arising from disputed transactions/billings, refund or purchase cancellation of goods or services. Maxis will do the adjustment as soon as reasonably practical for it to do so.
- Maxis does not have to honour any Reward Points which have not been earned in accordance with this SSTC and the decision by Maxis to adjust the Reward Points is final.
- Maxis reserves the right to change the Reward Points conversion rate.
- If there are insufficient Reward Points in the Account, your redemption will be unsuccessful. Maxis will decline the redemption request and notify you via the Account.
- If your Reward Points Wallet has a negative balance, any points you earn in the future will first be used to reduce that negative amount.
- You can earn Reward Points through:

- Reward Points can be used to redeem Reward Items listed in the Reward Catalogue.
- Redemption of the Reward Items must be submitted by the authorised person-in-charge of Account.
- You will not be able to redeem the Reward Items if your Account is under temporary suspension.
- If Maxis cancelled or terminate the Account for any valid reason, any remaining Reward Points will be forfeited totally. Maxis will not accept any redemption request thereafter.
- Once a redemption request is submitted in the Account, you will not be allowed to cancel, retract or change the redemption request unless the Reward Item is/are out of stock or no longer available. Maxis has the right to reject any request for refund or replacement for redemption request which has been successfully submitted.
- Maxis reserves the right not to entertain any request for refund or replacement for redemption which has been successfully submitted.
- Maxis is not obligated to replace any lost, damaged or stolen Reward Item after your acknowledgement of receipt of the Reward Item, for any reason whatsoever. Reward Item received in good condition are strictly non-refundable and non-exchangeable.

- Maxis reserves the right to change or replace the Reward Items in the Reward Catalogue including models and/or redemption points of devices, service and solutions without any prior notice.
- All Reward Items in the Reward Catalogue are available on a while stock last basis and Maxis may substitute it with any item of a similar value. Maxis may remove, discontinue and/or replace all or any of the Reward Items anytime without prior notice due to unavailability of the Reward Items or other reasonable grounds.
- Maxis assumes no responsibility for Reward Items provided by its Partners. In the case where Maxis is not the manufacturer or supplier of the goods and services, any query or complaint about the Reward Items should be directed to the respective Partners. Maxis is not responsible for handling complaints/disputes related to the use of the Reward Items and will not involve itself in warranty claims.

- Maxis reserve the right to cancel or reject any redemption of Reward Item including but not limited to the following reasons:
- the Reward Item is out of stock;
- the required top-up payment for the Reward Item is still outstanding (if applicable);
- the Account is under temporary suspension; or
- the Account is closed or terminated.
- In the case where your redemption request is rejected, the Reward Points will be refunded
- Maxis reserve the right to cancel or reject any redemption of Reward Item including but not limited to the following reasons:

- The Customer(s) Account will be terminated if the Customer(s) no longer have any active service with Maxis.
- The Customer(s) Reward Points in the Account will be forfeited totally and lapse if the Account is inactive or terminated notwithstanding that the Reward Points have yet to expire. The Customer(s) should redeem their Reward Points prior to the last service termination. Maxis will not accept any redemption request on or after the last termination date.
- The Customer(s) unutilised Reward Points will be forfeited (in parts or in whole) if the Customer(s) are in breach of these Terms & Conditions, General Terms & Conditions (“GTC”), Service Specific Terms & Conditions (“SSTC”), Summary Terms & Conditions (“STC”), Maxis Fair Usage Policy and any other applicable terms and conditions.
- Maxis can end the Loyalty Program at any time by giving the Customer(s) at least thirty (30) days’ prior notice.
- The Customer(s) will have until the end of the notice period to use any remaining Reward Points. After that the Reward Points will no longer be available for the Customer(s) to use.

- You agree that all data provided to Maxis for registration of the Account and to redeem the Reward Points are true, accurate, complete and current and that you shall maintain and update the data as needed throughout the period of you participating in this Enterprise Loyalty Program.
- You agree that Maxis may use and/or disclose your particulars (including data provided and submitted for the redemption request) to Partners(s) for the purpose of facilitating the redemption of the Reward Items.

- Certain features of the Enterprise Loyalty Program may require the input of corporate entity details, PIN and administrator password. You are solely responsible for the security, confidentiality & privacy of its corporate entity details, PIN, administrator password & any data or information stored on your device and/or for all the activities related to the Enterprise Loyalty Program. Maxis will not be liable for any damage, loss or leakage of the data resulting from unauthorized use of the Enterprise Loyalty Program or due to circumstances beyond Maxis’ control.
- You understand & agree that the use of the Enterprise Loyalty Program is at your own risk and that the Enterprise Loyalty Program is provided on an "as is" and "as available" basis, and Maxis expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to fitness for a particular purpose & non-infringement and/or that the Enterprise Loyalty Program will be free from loss, corruption, attack, viruses, interference, hacking or other security intrusion or that the Enterprise Loyalty Program will be affected by unforeseen circumstances or circumstances beyond Maxis' control.

- In the case you did not receive the eligible Reward Points, please contact us no later than thirty (30) days from the transaction date for our further checking. Maxis reserve the right to request you to provide information related to the Reward Points earned for validation. If you do not contact Maxis within thirty (30) days to raise the request or if you do not respond to Maxis’ request for further information by the required date, there shall be no further action required on Maxis and Maxis is not liable to fulfil any award of Reward Points.
