Service Specific Terms & Conditions – Zerolution360 for Business

- The Plan(s): Zerolution360 for Business. The Plan(s) cannot be exchanged for cash.
- You: A corporate or SME corporate (“Business Customer”) signing up for the Plan(s).
- The Plan(s) is not valid with any other offers and/or incentives, which have or may have been offered by Maxis under any other offers from time to time.
- The use of the Service(s) is subject to the General Terms & Conditions (“GTC”), Service Specific Terms & Conditions (“SSTC”), Summary Terms & Conditions (“STC”), Maxis Fair Usage Policy and any other applicable terms and conditions, all at www.maxis.com.my/business/tnc.
- Capitalised terms herein have the same meaning as defined in the GTC.
- Any conflict or inconsistency between this SSTC, the GTC and the STC, shall be construed in the following order of precedence: (a) SSTC; (b) GTC; and (c) STC. Further, the MaxisONE Business plan under the Plan(s) is subject to SSTC – MaxisONE Business plans (https://www.maxis.com.my/en/tnc/business-tnc/maxisonebusiness-addendum.html). For clarity, if there is any conflict or inconsistency between this SSTC and the SSTC – MaxisONE Business plans, this SSTC shall take precedence.
- The Plan(s): Zerolution360 for Business. The Plan(s) cannot be exchanged for cash.

- The minimum Commitment Period of the Plan(s) is either:
- twenty four (24) months; or
- twelve (12) months
- If applicable, with the acceptance of this Plan(s), your previous phone/device offer contract is deemed terminated as at the Date of Execution and you shall be subject to any early termination charges of the previous contract.
- After the Commitment Period has expired, you are entitled to either:
- continue your use of the Device under Zerolution360 for Business; or
- choose to return the Device to us, in good working condition, by calling 1919, email us at bizcare@maxis.com.my or contact your Relationship Manager. You accept and acknowledge that you may be charged a collection fee when you return the Device to us. from the date of acceptance of these terms and conditions (“Date of Execution”).
- The minimum Commitment Period of the Plan(s) is either:

- To be eligible for this Plan(s) you must:
- be our existing Business Customer of 6 months or more with a minimum monthly bill of RM150; and
- subscribe to any MaxisONE Business plans from BS48 to MOB 188 or any Maxis ONEBusiness Flexi plans.
- Any cancellation of your MaxisONE Business plans will result in the termination of your Zerolution360 for Business subscription and a penalty charge.
- This Plan(s) is not available to you if:
- you have any outstanding balance with us;
- you are a new Business Customer of less than 1 year; or
- you are a business individual customer.
- To be eligible for this Plan(s) you must:

- By accepting this offer: you will enjoy the usage of 1 device (“Device”) at the price as offered by us, which is exclusive of all applicable taxes (“Zerolution360 for Business Fee”).
- You shall not, during the Commitment Period:
- terminate your subscription to Zerolution360 for Business;
- terminate or suspend your Maxis mobile account or port out to another mobile service provider;
- have your Maxis mobile account terminated for non-payment of monthly bills;
- change your rate plan to a rate plan that is lower than the rate plan you had registered for pursuant to the Offer;
- change or transfer ownership of this Plan and Service(s); and/or
- cause any loss or damage to the Device.
- If any of the events in clause 14 above occurs, you shall pay us an early termination charge as set out in clause 16 below.
- Applicable early termination charges are set out below: For 24 months contract: You agree that Maxis has the right to impose an early termination charge you are responsible to pay if you terminate your 24-months contract before its expiry. The early termination charge is calculated based on: Zerolution360 for Business Fee x remaining months. Payment of the early termination charge is payable by you in addition to all monies owing to us up to the time of early termination. For 12 months contract: You agree that Maxis has the right to impose an early termination charge you are responsible to pay if you terminate your 12-months contract before its expiry. The early termination charge is calculated based on: Zerolution360 for Business Fee x remaining months. Payment of the early termination charge is payable by you in addition to all monies owing to us up to the time of the early termination.
- If you do not return the Device after termination and/or expiry of the Commitment Period, you shall be responsible to pay the following charges: For 24 months contract: You agree that Maxis has the right to impose charges if you do not return the Device after termination and/or expiry of your 24-months contract before its expiry. The early termination charge is calculated based on: Zerolution360 for Business Fee x remaining months + one-time non-returned device fee. Payment of the early termination charge is payable by you in addition to all monies owing to us up to the time of early termination. For 12 months contract: You agree that Maxis has the right to impose charges if you do not return the Device after termination and/or expiry of your 12-months contract before its expiry. The early termination charge is calculated based on Zerolution360 for Business Fee x remaining months + one-time non-returned device fee. Payment of the early termination charge is payable by you in addition to all monies owing to us up to the time of the early termination.
- If you suspend your Maxis mobile account during the Commitment Period, the Zerolution360 for Business Fee will continue to be charged to you.
- You agree we have the rights to block the IMEI of the Device if you are:
- suspected of fraud or found to have committed fraud; or
- after signing up to the Offer, you fail to make payment for a continuous period of three (3) months; or
- the Device has been reported as lost with a police report has been provided to Maxis.
- You accept and acknowledge you will be liable for the Plan, Commitment Period, Device payment and charges, these terms and conditions and the GTC.
- You accept and acknowledge that the Device title and ownership does not belong to you. The Device is provided under this Plan to you and you are accountable for the use and safety of the Device. Nothing in this SSTC shall be construed as transferring the title or ownership of the Device to you. You shall not directly or indirectly give or allow another person to give any interest in or lien over the Device. You shall promptly, at your own costs and expenses, take all such actions as may be necessary to duly discharge or eliminate any such liens upon obtaining actual knowledge thereof.

- Upon subscribing to the Plan(s) and subject to clause 24 below, you are entitled to upgrade to a new Device.
- When you choose to exercise your upgrade under the Upgrade Plan, you will be charged an Upgrade Fee which is dependent on the time period upon which you upgrade.
- In order to be eligible for the Upgrade Plan, you must:
- fulfil at least 12 months of Plan(s) in order for us to waive-off the remaining months of your Zerolution360 for Business Fee; and
- return your Device in “good working condition” as stipulated in the Device Return Guidelines (for a device upgrade); and
- pay the Upgrade Fee upon signing up for the Upgrade Plan.
- You are not entitled to the Upgrade Plan if you subscribe to a twelve (12) month Commitment Period.
- Once you exercise your right to upgrade your Device under this Upgrade Plan, your minimum Commitment Period of twenty four (24) months restarts from the date of upgrade.
- You may be entitled to a discount on the Upgrade Fee if you upgrade to a MaxisONE Business 158 plan or MaxisONE Business 188 plan. Maxis reserves the right to determine whether or not you are eligible for the discount.
- You shall not, during the Commitment Period:
- terminate your subscription to Zerolution360 for Business;
- terminate or suspend your Maxis mobile account or port out to another mobile service provider;
- have your Maxis mobile account terminated for non-payment of monthly bills;
- change your rate plan to a rate plan that is lower than the rate plan you had registered for pursuant to the Offer;
- change or transfer ownership of this Plan and Service(s); and/or
- cause any loss or damage to the Device.

- The Zerolution360 for Business Device Protection services shall be provided by Brightstar Distribution Sdn Bhd and Brighstar Supply Chain Services (collectively referred to as “Brightstar”) and shall be subject to Brightstar’s terms and conditions which can be found at (https://www.maxis.com.my/en/terms-conditions/devices/contract/zerolution360/)
- Upon signing up for the Plan(s), you will automatically be enrolled in the Zerolution360 for Business Device Protection Premium Plan (“Premium Plan”). Once you have enrolled in Zerolution360 for Business Device Protection Premium Plan, you will not be eligible to enrol in a different Device Protection service.
- The Zerolution360 for Business Device Protection services shall be provided by Brightstar Distribution Sdn Bhd and Brighstar Supply Chain Services (collectively referred to as “Brightstar”) and shall be subject to Brightstar’s terms and conditions which can be found at (https://www.maxis.com.my/en/terms-conditions/devices/contract/zerolution360/)

- You may contact Brightstar at 1800-886-888, for the repair and maintenance of your Device or any part thereof.
- Any repair and maintenance of your Device or any part thereof shall be treated as a Service Request under the Zerolution360 for BusinessDevice Protection.
- You accept and acknowledge that you may be charged a fee when Brightstar collects the Device from you for repair and/or maintenance.
- You may contact Brightstar at 1800-886-888, for the repair and maintenance of your Device or any part thereof.

- For purposes of security, you are required to verify your identity by biometric (i.e. fingerprint) authentication with your valid and working identity card at the point of delivery. We reserve the right to not release the Device in cases of your failure and/or refusal to verify your identity.
