Service Specific Terms & Conditions ("SSTC") - Maxis Business Postpaid

Version [11 January 2024]

    1. Maxis Business Postpaid (“Plan(s)”): Comprises of Maxis Business Postpaid Share 48, Maxis Business Postpaid 79, Maxis Business Postpaid 109, Maxis Business Postpaid 139, Maxis Business Postpaid 169 or Maxis Business Postpaid 199.
    2. You: The Business Customer signing up for the Plan(s).
    3. The use of the Plan(s) and Service(s) is subject to the General Terms & Conditions (“GTC”) at https://www.business.maxis.com.my/en/terms-conditions/business/general/tnc/, Service Specific Terms & Conditions (“SSTC”), Summary Terms and Conditions (“STC”), Maxis Fair Usage Policy and any other applicable terms and conditions, all at https://www.business.maxis.com.my/terms-conditions/business/.
    4. Capitalised terms herein have the same meaning as defined in the GTC.
    5. Any conflict or inconsistency between this SSTC, the GTC and STC, shall be construed in the following order of precedence: (a) SSTC; (b) GTC; and (c) STC.
    6. We reserve the rights without liability, to vary, add to, remove or otherwise amend this SSTC, the manner in which the Plan(s) is conducted and/or discontinue, interrupt, bar, suspend, restrict and/or terminate the Plan(s) (whether in whole or in part) at any time as we deem fit whether with or without prior notice to you and will not be liable to you and/or any third party for any loss (including loss of revenue), loss of services or connectivity or inconvenience as a result thereof. Where no prior notice is provided, Maxis will to the extent commercially reasonably practicable provide you with prior notice of such changes in any form as Maxis deems reasonable and appropriate. The prevailing terms and conditions of this SSTC and the Plan(s) will be updated on our official website from time to time, whereby the updated terms and conditions will apply and supersede all previous versions. Your continued use of the Plan(s) after any changes to the terms and conditions of this SSTC and the Plan(s) is effective will constitute unconditional acceptance by you of such variations, additions or amendments and you will be bound by the same.
    1. You must be our Business Customer.
    2. To subscribe to Maxis Business Postpaid Share 48, you must subscribe to one (1) Maxis Business Postpaid 109, Maxis Business Postpaid 139, Maxis Business Postpaid 169 or Maxis Business Postpaid 199.
    3. You are ineligible for the Plan(s) if you have any outstanding payments with us.
    4. We reserve the rights to change the eligibility criteria for the Plan(s) at any time.
    1. The Charges and rates as set out in the Plan(s) structure is in the appended Appendix in this SSTC and may be updated by us at our sole and absolute discretion as published on our official website at https://www.business.maxis.com.my/en/plans/postpaid-plan/ from time to time, where the updated structure will apply and supersede all previous versions including the structure appended herein. Charges and rates published are exclusive of all applicable taxes.
    2. For the Plan(s), a monthly commitment fee as stated at https://www.business.maxis.com.my/en/plans/postpaid-plan/ will be applicable to the Plan(s) that you have subscribed to.
    3. You agree that you shall also be liable for the full charges of any external subscription, activation of value-added services, add-ons, International Roaming (including Roam 120) and/or International Direct Dial (IDD) Bundle (including 132) (“Other Subscriptions”) purchased when you are on the Interim Plan (defined below) and/or the Plan(s). These charges will be added to the bills issued to you.
    4. You will be charged the monthly commitment fee for the Plan(s) that you have subscribed to and charges for any additional lines requested within the same account including charges for Other Subscriptions upon the first Mobile Number being successfully registered or Ported into the respective Plan(s).
    1. The Plan(s) shall continue for twenty-four (24) months or an agreed minimum period of service as stated in the Registration Form (“Minimum Period of Service”) from the date of activation of the Service(s) if subscribed with any Mobile Device contract, Enterprise Loyalty Program, Zerolution, rebate model and/or roaming offers.
    2. You acknowledge and agree that you must have at least one (1) active line under Maxis Business Postpaid 79, Maxis Business Postpaid 109, Maxis Business Postpaid 139, Maxis Business Postpaid 169 or Maxis Business Postpaid 199 at any one time during the Minimum Period of Service.
    1. Non-payment for any one of the Plan(s) may result in suspension or barring of all the Service(s) until the outstanding amount is paid.
    1. You acknowledge and accept, for the voice & SMS' allocated with the Plan(s) that the unlimited minutes and SMS':
      • apply to domestic mobile/fixed ON-net (Maxis to Maxis calls and SMS’) & OFF-net (calls and SMS’ from Maxis to other Service Provider) usage for the Plan(s) (excluding, video calls, calls to special numbers, eg. 1-300/1-800/600, 121, TM100, 1MOCC, 02-prefix numbers for IDD calls to Singapore & 080-prefix numbers for border calls to Brunei);
      • are for standard person to person calls or texts;
      • it is NOT meant for multiple simultaneous calling, conference calling, re-supply, call centre usage, telemarketing, bulk messaging, application-to-person communication, continuously call forwarding, auto-dialing, machine-to-machine communication (including by using your SIM Card in any other Mobile Device), Cellular Trunking Units (CTUs), or any other activity we consider to be non-standard usage.
    1. You must: -
      • have a 5G capable, supported and enabled Mobile Device to access/ utilize the 5G network. Please check the latest list of 5G capable, supported and enabled Mobile Device at https://www.maxis.com.my/en/about-maxis/5g-network/#eligible-devices which list may be updated from time to time. A 5G software update from the Mobile Device manufacturer may be required which will be your sole responsibility and shall not be the responsibility of Maxis;
      • be located within the 5G network coverage area. A map of 5G network coverage area can be found at https://www.maxis.com.my/en/about-maxis/5g-network/#5g-map; and
      • have a 4G LTE enabled SIM Card. You may check your SIM Card status by dialing this code *100*8*5# from your phone.
    2. The 5G service(s) is only available within the 5G network area via use of a 5G capable, supported and enabled Mobile Device. When you are located outside the 5G network coverage area, you’ll automatically switch to any of our other available networks.
    1. Maxis does not represent, warrant, undertake and/or guarantee that: -
      • the 5G service(s) will be provided without errors;
      • the 5G service(s) will be uninterrupted;
      • your experience of the existing services which you are subscribing from Maxis on our other available networks will not be impacted in an adverse manner; and/or
      • Maxis will and is able to correct or rectify all or any part of the errors, interruption or such adverse impact to the existing services.
      You understand and acknowledge that the services offered pursuant to the 5G service(s) may be subject to limitations, delays and other problems inherent in communication facilities and network and or the third party 5G network, including the internet and Maxis shall not be responsible to you and/or any third party for any delays, delivery, failures, or other damage or loss resulting from or in connection with such problems.
    2. Without derogating from the disclaimers and limitation of liability under the GTC which are applicable to you, Maxis makes no representation or give any condition, indemnity, warranty, guarantee, whether express or implied, about whether the services offered pursuant to the 5G service(s) will operate and be compatible with any Content, Equipment, hardware or software or that it will be compatible with the national 5G wholesale network. You acknowledge and agree that Maxis relies on one or more third party service providers in relation to the 5G service(s) (including its availability and continuity) and as such, to the fullest extent permitted by law, Maxis excludes any liability and shall not be liable to you and/or any third parties whether in contract, tort or otherwise for any loss, damage or liability incurred or sustained by you and/or any third party (including loss of revenue or loss of services or connectivity) caused by or in relation to any delay, failure, breakdown, inability to use or access, interruption or disruption by any of our third party service providers including Maxis’ third party service provider of the national  5G wholesale network or in respect of interruption or adverse impact to existing services subscribed from Maxis arising from your purchase of the Plan(s).
    3. Notwithstanding anything to the contrary in this SSTC, you acknowledge and agree that: -
      • you have not relied on any representation, warranty, statement or similar made by Maxis’ third party service provider of the national 5G wholesale network in connection with your decision to use or the manner in which you will make use of the 5G service(s) including where such 5G service(s) is provided to you as part of products or services (or bundled products or services) by Maxis;
      • you are solely responsible for your decision to use, and the manner in which you will make use of, the 5G service(s) and does so at your own risk (including where the 5G service(s) is used in connection with the preservation of life or property);
      • you are solely responsible for making your own decisions on appropriate alternative redundancy, connectivity and data solutions in the event the 5G service(s) is unavailable, disrupted or operate with error;
      • the 5G service(s) will not necessarily operate without error and will not always be available;
      • Maxis’ third party service provider of the national 5G wholesale network does not owe you any duty of care or similar duty and you release Maxis’ third party service provider of the national 5G wholesale network from any liability arising from your use of the 5G service(s); and
      • you must not do anything that may interfere with Maxis’ third party service provider of the national 5G wholesale network and/or connect or knowingly permit any third party to connect any equipment to the 5G network.
    1. We reserve the rights at any time at our sole discretion whether with or without notice to you and without being liable to you and/or any third party, to immediately interrupt, bar, suspend or restrict the Service(s) (including 5G service(s)) for such time as we see fit, withdraw or terminate, discontinue or disconnect the Service(s) including if:
      • any technical failure occurs in services pursuant to the 5G service(s), Plan(s) or our Network (which includes any network operated by any third party which are connected to Maxis’ network);
      • the services pursuant to the 5G service(s), Plan(s), our Network or systems are being upgraded, modified or maintained;
      • your usage shows excessive usage or placing unusual burdens on our Network;
      • in our determination that the Plan(s) is or may be used by you for unlawful activities or for suspected fraudulent activities;
      • your usage is not in accordance with the Maxis Fair Usage Policy at www.maxis.com.my/FUP or contrary to any of the terms and conditions of this SSTC and/or the GTC;
      • is for reselling purposes;
      • where matters beyond our reasonable control prevents us from performing and/ or continuing our obligations in this SSTC, the GTC and/or the Maxis Fair Usage Policy;
      • you have relocated or have been relocated to an area outside the 5G network coverage area; or
      • we are required to do so by law, statute, enactment, regulations, code or by any relevant authorities, including the Maxis’ third party service provider of the national 5G wholesale network,
      and where no prior notice is provided, Maxis may to the extent commercially reasonably practicable give you notice of such changes in any form as Maxis deem reasonable or appropriate.
    2. If you change your existing rate plan to the Plan(s), all promotions/ benefits that you are currently enjoying under your existing rate plan may be forfeited and you may not be able to carry forward any promotions/ benefits to the Plan(s).
    3. In connection to any Plan(s) survey, comments, suggestions and/or feedback submitted by you to Maxis, you agree that Maxis may use all comments, suggestions and feedback collected in any manner without restriction or obligation for any purpose, including but not limited to incorporation or implementation of such comments, suggestions and feedback into Maxis’ product or service, to develop, improve and/or evaluate the Plan(s). Except for personal data, no comments, suggestions and/or feedback will be deemed as your confidential information.
    1. For group shareable mobile data allocated with the Plan(s), you acknowledge and accept:
      • Each line under the Plan(s) will be allocated with a mobile data usage limit based on the Plan(s) that you subscribed to and subject to any changes by Maxis upon subscribing to the Plan(s).
      • You are free to adjust the mobile data limit to suit the needs of each line with a minimum of 100MB per line within the limits allocated under the Plan(s) subscribed by you.
      • The mobile data browsing speed will be throttled and you may continue to use the mobile data services with no EXCESS charge where:
        • the collective usage of the mobile data from all lines under the Plan(s) exceeds the mobile data allocated to the group shareable mobile data pool subscribed by you; or
        • a line under the Plan(s) subscribed exceeds the mobile data limit set by you.
      • The mobile data usage limit allocated under the Plan(s) is exclusively for domestic usage only.
      • The Plan(s) allows for you to purchase the mobile data pass which are non-shareable ("Mobile Internet Pass”). It is to be used solely by the assigned line and will be automatically renewed at the end of your bill cycle if you subscribe to a monthly Mobile Internet Pass. If you subscribe to a time-based Mobile Internet Pass, your Mobile Internet Pass will not be automatically renewed. Refer to the attached Appendix in this SSTC for the Mobile Internet Pass rates.
      • If your account under this Plan(s) is not active, you will not be able to enjoy the group shareable mobile data.
      • Productivity data:
        • The productivity data refers to domestic mobile data usage on Office365, Microsoft Teams, Skype, WhatsApp, WeChat, Microsoft Outlook, OneDrive and Zoom application ("Productivity Applications”), applicable on Maxis networks.
        • You will receive the productivity data depending on the Plan(s) that you have subscribed to (as per the Appendix in this SSTC) and the productivity data quota will be refreshed at the end of your bill cycle.
        Once you have exceeded the productivity data quota, you will be using your rate plan data quota to access the Productivity Applications.
    1. You acknowledge and accept:
      • Any request for additional lines within the same account can only be made once you meet the minimum subscription of one (1) Maxis Business Postpaid 79, Maxis Business Postpaid 109, Maxis Business Postpaid 139, Maxis Business Postpaid 169 or Maxis Business Postpaid 199 plans.
      • These additional lines will be renewed automatically at the end of your bill cycle.
      • Each additional line will be charged according to the respective Plan(s) monthly fee.
      • If you add on lines: the fee payable will be pro-rated against your bill cycle date. You will be charged full price from the second month onwards. There will be no refund for unused / inactivated lines under the Plan(s).
    1. The terms and conditions of the Enterprise Loyalty Program is as set out in Maxis’ website at https://www.business.maxis.com.my/en/terms-conditions/business/campaigns/enterprise-loyalty-programme/.
    1. The terms and conditions of the Mobile Device is as set out in Maxis’ website at http://www.business.maxis.com.my/en/terms-conditions/business/plans/mobile-device
    1. Upon our acceptance of your application and your request to Port in your identified Mobile Numbers to the respective Plan(s), you acknowledge and agree that the Mobile Numbers that are successfully ported to us shall be temporarily placed onto an interim plan (“Interim Plan”) before being subscribed to the respective Plan(s).
    1. The Charges and rates outlined in the Plan(s) structure (as per the Appendix in this SSTC) do not account for usage while on an overseas roaming network. Whilst roaming overseas, the prevailing data roaming charges at https://www.business.maxis.com.my/mobile/international-roaming/ applies.
    1. This IDD Pass is exclusively for subscriber of the Plan(s) who make IDD or border calls for the countries mentioned at https://www.business.maxis.com.my/mobile-plans/idd-saver/ for IDD Pass via direct dialing.
    2. IDD Calls made via IDD 132 calls are not eligible for this IDD Pass.
    3. You can purchase the IDD Pass by either:
      • calling Maxis' business customer care line at 1800-82-1919 or 1919; or
      • via the Maxis Business Hub.
    4. The IDD Pass is bundled with minutes usage which will be activated upon availability. You are entitled to full minutes allocation until the next bill cycle. Unused minutes will be forfeited.
    5. Any IDD calls prior to the pass activation will be charged on pay per use basis and not part of the IDD Pass.
    6. The IDD Pass is valid and renewable at every billing cycle.
    7. You may only purchase one IDD Pass per month for each line subscribed at any given time.
    8. In the event that your allocated minutes are completely utilized, you may purchase a one-time add-on IDD Pass which shall be valid until the next billing cycle.  Any subsequent one-time add-on IDD Pass purchased under this Clause 40 must be of the same monthly IDD Pass as previously subscribed for.
    9. The IDD Pass will be charged with the full amount and given full minutes allocation regardless of any termination within the billing cycle (pro-rate does not apply).
    10. The countries and charges for IDD Pass at https://www.business.maxis.com.my/mobile-plans/idd-saver/ shall apply.
    1. Subject to the GTC and this SSTC, you may at any time terminate the Plan(s) as follows:
      • by writing in to customercare@maxis.com.my or bizcare@maxis.com.my; or
      • by calling our business customer care line at 1-800-82-1919 or dial 1919 from your mobile; or
      • by walking into our Maxis Centre’s listed on www.maxis.com.my.

Appendix – Service Specific Terms & Conditions (“SSTC”)

  • One (1) Maxis Business VoiceGo service free of charge for twenty-four (24) month for each Plan(s).
